Tomorrow, Sunday 8 November 2026, is the last day for a large group of employers to update their establishment registration on the Shram Suvidha Portal. The Occupational Safety, Health and Working Conditions (Central) Rules, 2026 — notified by the Ministry of Labour and Employment as G.S.R. 345(E) on 8 May 2026 — give employers whose establishments are already registered under another Central labour law six months to update their registration particulars in Form I. That six-month window closes on 8 November 2026. No extension of the deadline has been announced as of 7 November 2026.
Quick Answer
Under the Occupational Safety, Health and Working Conditions (Central) Rules, 2026 (G.S.R. 345(E), 8 May 2026), every employer whose establishment is already registered under another Central labour law must update its registration particulars in Form I on the Shram Suvidha Portal by 8 November 2026 — six months from the date the Rules came into force.
The deadline at a glance
What changed
The four Labour Codes — the Code on Wages, 2019, the Industrial Relations Code, 2020, the Code on Social Security, 2020, and the Occupational Safety, Health and Working Conditions Code, 2020 (the OSH Code) — came into force on 21 November 2025. The OSH Code consolidates 13 Central labour enactments, including the Factories Act, 1948, the Contract Labour (Regulation and Abolition) Act, 1970, the Mines Act, 1952, and the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, into a single code on safety, health and working conditions.
The Codes set the principles; the Central Rules supply the working detail — the forms, the portal, the timelines. On 8 May 2026 the Ministry of Labour and Employment notified the Occupational Safety, Health and Working Conditions (Central) Rules, 2026, made under sections 133 and 134 of the OSH Code, 2020. The Rules supersede 15 earlier sets of rules, among them the Contract Labour (Regulation and Abolition) Central Rules, 1971, the Mines Rules, 1955, the Building and Other Construction Workers (Regulation of Employment and Condition of Services) (Central) Rules, 1998, and the Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Central Rules, 1979.
Chapter II of the Rules deals with registration. Every establishment must now carry a single registration under the OSH Code, applied for electronically in Form I on the Shram Suvidha Portal. Establishments that were already registered under an older Central labour law are not asked to register afresh — they are asked to bring their registration particulars up to date in Form I. Rule 3(6) gives them six months from the date the Rules came into force to do it. The Rules came into force on 8 May 2026, so the six months end on 8 November 2026.
Who must act by 8 November 2026
The duty falls on the employer of an establishment already registered under any other Central labour law for the time being in force. In plain terms: if your establishment holds a registration under one of the older Central labour laws — for example, a factory licence under the Factories Act, a registration under the Contract Labour Act, or a registration under the BOCW Act — and the Central Government is the appropriate government for your establishment, you must update your registration particulars in Form I on the Shram Suvidha Portal by 8 November 2026.
Establishments that were never registered under any Central labour law are in a different position: they register as new establishments under Rule 3(1), applying electronically in Form I. The Rules also refer to a 60-day window for registration, with a late fee after that period to be specified by a general or special order of the Central Government (Rule 3(3)) — the amount of that late fee is not fixed in the Rules themselves.
Scope note — read this first: the Central Rules apply where the Central Government is the appropriate government for the establishment. Establishments that fall under a State's jurisdiction follow the rules notified by their State government, not these Central Rules. If you are unsure which government is the appropriate government for your establishment, check your existing registration — it will show the registering authority — before assuming the 8 November date applies to you.
What to do — updating Form I on the Shram Suvidha Portal
Rule 3(1) requires the application to be made electronically in Form I, containing the particulars of the establishment, accompanied by documents relating to registration of the establishment and proof of identity and address, on the Shram Suvidha Portal or the portal designated by the Central Government. For an employer updating existing particulars, the practical steps are:
- Log in to the Shram Suvidha Portal with the credentials linked to your establishment's existing registration.
- Open the registration for your establishment and select the option to update the registration particulars in Form I.
- Check every particular already on record — establishment name and address, nature of work, number of workers, contractor details where applicable — and correct anything that has changed since the original registration.
- Upload the supporting documents the portal asks for: documents relating to the registration of the establishment, and proof of identity and address.
- Submit Form I and keep the acknowledgement. The portal generates the submission record; note the date and time, because the 7-day certificate clock in Rule 3(2) runs from the date of submission of a complete application.
- Quote your registration number on all documents and correspondence connected with the Rules — Rule 3(7) requires it.
Do the update before the portal's last day, not on it: a submission that is incomplete does not start the certificate clock, and a last-minute portal rush is the most common reason a filing slips past a deadline.
What happens after you update
Once a complete application is submitted, Rule 3(2) requires the certificate of registration to be issued in Form III electronically, forthwith and in any case not later than seven days from the date of submission of the complete application. If the certificate is not issued within that period, the establishment is deemed to have been registered and the certificate of registration in Form III is auto-generated. The same 7-day discipline applies to amendments: under Rule 3(8), where an application for amendment is complete, the amended certificate in Form III must be issued electronically within seven days, failing which it is auto-generated.
The certificate of registration is non-transferable and must be displayed at conspicuous places within the premises of the establishment (Rule 3(4)). The registering officer maintains the register of establishments in Form V (Rule 3(9)).
The ongoing 30-day duty
The 8 November deadline is a one-time transition duty, not the end of the employer's obligations. Rule 3(8) provides that any change in the particulars furnished in Form I must be updated on the portal by the employer within thirty days of the change. A change of address, a change in the nature of work, a change in contractor details — each must be reflected on the portal within 30 days, and the amended Form III certificate follows within seven days of a complete amendment application, or is auto-generated.
Closure has its own timeline: under Rule 3(10), the employer must, within thirty days of the closing of the establishment (other than mines), intimate the Registering Officer and the Inspector-cum-Facilitator in Form II, along with a certificate of payment of all dues and statutory returns to the workers. That information is auto-shared with the Employees' Provident Fund Organisation and the Employees' State Insurance Corporation. The cancellation certificate in Form IV follows within sixty days of a complete Form II, or is auto-generated (Rule 3(11)).
Old system vs new system
What the Rules do not say
Two points deserve a clear statement, because they are easy to get wrong. First, no penalty amount is stated in the Rules for missing the Form I update itself. The Rules give the Registering Officer power, under Rule 3(5), to direct an employer who fails to comply with Rule 3(1) to comply within a specified time. A late fee is mentioned only for registration after the 60-day period in Rule 3(3), and its amount is left to a general or special order of the Central Government — it is not fixed in the Rules. This article therefore states no penalty figure for the 8 November update, because none is verified.
Second, no extension of the 8 November 2026 deadline has been announced. As of 7 November 2026, checks of the Ministry of Labour and Employment's notifications and press releases show no order extending the six-month window in Rule 3(6). Employers should work to the 8 November date. If the Ministry issues an extension, this article will be updated.
Frequently asked questions
What is the last date to update Form I on the Shram Suvidha Portal?
8 November 2026. Rule 3(6) of the Occupational Safety, Health and Working Conditions (Central) Rules, 2026 gives establishments already registered under another Central labour law six months from 8 May 2026 — the date the Rules came into force — to update their registration particulars in Form I.
Who has to update Form I by 8 November 2026?
Employers of establishments already registered under any other Central labour law for the time being in force, where the Central Government is the appropriate government. Establishments under a State's jurisdiction follow their State's rules instead.
How do I update Form I on the Shram Suvidha Portal?
Log in to the Shram Suvidha Portal, open your establishment's registration, update the particulars in Form I, upload the registration documents and proof of identity and address the portal asks for, and submit. Keep the acknowledgement — the 7-day certificate clock runs from the date of a complete application.
What happens after I submit the Form I update?
The certificate of registration in Form III must be issued electronically within seven days of a complete application. If it is not issued in that time, the establishment is deemed registered and the Form III certificate is auto-generated (Rule 3(2)).
What if my establishment's details change later?
Update the particulars in Form I on the portal within 30 days of the change. The amended Form III certificate must then be issued within seven days of a complete amendment application, or it is auto-generated (Rule 3(8)).
Is there a penalty for missing the 8 November 2026 deadline?
No penalty amount for the Form I update is stated in the Rules. The Registering Officer may direct a non-complying employer to comply within a specified time (Rule 3(5)). A late fee is mentioned only for registration after the 60-day period in Rule 3(3), and its amount is to be specified by a separate order.
Do the OSH (Central) Rules, 2026 apply to my establishment?
They apply where the Central Government is the appropriate government for the establishment. If your establishment falls under a State's jurisdiction, your State's rules apply instead — check your existing registration to see which authority registered you.
